The owner of the online store www.upwise.ee is UpWise Coaching OÜ, registry code 14540935, located at Mari tn 7, Pärnu.

Validity of the Sales Contract, Product and Price Information

The sales conditions apply when purchasing goods from the online store. The prices of products sold in the online store are indicated next to the products. A fee for the delivery of goods is added to the price. All prices in the online store are in euros.

The cost of delivering goods depends on the buyer’s location and the method of delivery. The delivery fee is displayed to the buyer when placing the order. Information about the goods is presented in the online store right next to the goods.

Placing an Order

To order goods, add the desired products to the shopping cart. To place an order, fill in the required fields and choose a suitable method of delivery for the products. The amount to be paid, which can be paid securely through the following payment methods, will then be displayed on the screen:

– Bank transfer or
– Online banking links

The owner of the online store is the responsible processor of personal data.

If the ordered goods cannot be delivered due to the end of goods or for another reason, the buyer will be notified as soon as possible, and the paid money (including delivery costs) will be refunded immediately, but no later than 14 days from the date of notification.


Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland, and other European countries.

For receiving the goods, the buyer has the following options: Omniva parcel machine or post office.

The buyer bears the shipping costs, and the respective price information is displayed next to the shipping method.

Domestic shipments in Estonia generally reach the designated destination within 2-7 business days from the effectiveness of the sales contract. Delivery outside Estonia takes place within 10-40 calendar days.

In exceptional cases, the right to deliver goods within 45 calendar days is reserved.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days (depending on the products, the buyer may not have the right of withdrawal, in which case the respective products and services must be listed and must meet the conditions listed in § 53 para 4 of the Law of Obligations Act).

The right of withdrawal does not apply if the buyer is a legal entity.

To use the 14-day return right, the ordered goods must not be used in any way other than necessary to ensure the nature, characteristics, and functioning of the goods, in the manner that would be allowed for testing the goods in a physical store.

If the goods have been used for purposes other than necessary for ensuring the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the online store has the right to reduce the refundable fee according to the decrease in the value of the goods.

To return the goods, a notice of withdrawal from the purchase of the goods must be submitted and sent to the email address upwisecoaching@gmail.com no later than 14 days from the receipt of the goods.

The buyer bears the cost of returning the goods, except when the reason for the return is that the returned product does not match the ordered product (e.g., wrong or defective product).

The buyer must return the goods within 14 days following the submission of the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.

The online store will immediately return all fees received from the buyer under the contract upon receipt of the returned goods, but no later than 14 days after receiving the withdrawal notice.

The online store may refuse to make refunds until it has received the object of the contract back or until the buyer has provided evidence of having sent the item back, depending on which occurs first.

If the buyer has explicitly chosen a different method of delivery than the cheapest standard delivery method offered by the online store, the online store does not have to reimburse the cost that exceeds the expense associated with the standard delivery method.

The online store has the right to withdraw from the sales transaction and demand the goods back from the buyer if the price of the goods in the online store is marked significantly below the market price due to an error.

Right to Submit a Complaint

The online store is responsible for the non-conformance or defect of the goods sold to the buyer that was present at the moment of transfer and becomes apparent within two years from the delivery of the goods to the buyer. During the first six months from the transfer of the goods to the buyer, it is assumed that the defect was present at the time of transfer. The burden of rebutting this presumption lies with the online store.

The online store is not responsible for defects that have occurred after delivering the goods to the buyer.

If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will return all fees associated with the sales contract to the buyer.

The online store responds to the consumer’s complaint in writing or in a form that enables written reproduction within 15 days.

Direct Marketing and Processing of Personal Data

The online store uses the personal data entered by the buyer only to process the order and to send the goods to the buyer. The online store transmits personal data to the shipping companies to deliver the goods.

The online store sends newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish to receive them by entering an e-mail address on the website and indicating their desire to receive direct mail.

The buyer can at any time opt out of offers and newsletters sent by e-mail by notifying us via e-mail or by following the instructions provided in the e-mail containing the offers.

Dispute Resolution

If the buyer has complaints regarding the online store, they must be sent to the e-mail address upwisecoaching@gmail.com or call +372 5140 040.

If the buyer and the online store cannot resolve the dispute by agreement, the buyer may turn to the Consumer Disputes Committee. The committee is competent to resolve disputes arising from a contract between the buyer and the online store. The examination of the buyer’s complaint by the committee is free.

The buyer may also turn to the European Union consumer dispute resolution platform.
